1. Definitions

In these Terms and Conditions:

• Breezeway refers to the charter business operating from 27/4 Lamai Beach Road, Koh Samui, Surat Thani 84310, Thailand.
• Charter refers to the private yacht sailing service arranged between Breezeway and a guest or group.
• Guest means any individual or group booking or participating in a charter.
• Website means the site available at https://breezew.biz.
• Agreement means these Terms and Conditions as accepted by the Guest at the time of booking.

2. Acceptance of Terms

By submitting an enquiry through this website, making a booking, or participating in a charter, Guests agree to be bound by these Terms. All Guests must be aged 18 or over to make a booking. Guests under 18 may participate in a charter when accompanied by a responsible adult who has made the booking and accepts these Terms on behalf of the group.

3. Services

Breezeway provides private yacht charter services from Lamai Beach, Koh Samui. The services available are:

• Lamai Coast Morning Sail (approx. 4 hours)
• Gulf Crossing to Koh Phangan (approx. 8 hours)
• Three-Island Multi-Day Voyage (3–5 days)

All charters are private — no shared bookings are made. Service availability is subject to vessel readiness and weather conditions.

4. Booking and Confirmation

A charter enquiry does not constitute a binding booking until Breezeway confirms availability and the Guest confirms acceptance. Charter dates are considered confirmed only once written confirmation has been issued by Breezeway. Breezeway reserves the right to decline any enquiry without explanation.

5. Pricing and Payment

Charter prices are quoted in Thai Baht (THB) and cover the whole vessel for the duration stated:

• Lamai Coast Morning Sail: ฿10,000
• Gulf Crossing to Koh Phangan: ฿24,000
• Three-Island Multi-Day Voyage: ฿29,000 per day

Prices include the items stated for each charter type. Additional requests made after confirmation may incur additional charges, which will be communicated and agreed before the charter date. Payment terms will be specified at the time of booking confirmation.

6. Cancellation and Rescheduling

Guest cancellation

Cancellation terms will be specified in the booking confirmation. As a general guide, cancellations made more than 72 hours before the charter date may be rescheduled without charge. Cancellations with less than 72 hours' notice may incur a partial charge. Specific terms are confirmed at booking.

Weather and safety cancellation by Breezeway

If Breezeway determines that weather or sea conditions make a departure unsuitable, the charter will be postponed and rescheduled without additional charge to the Guest. Breezeway's assessment of conditions is final in these matters.

7. Guest Responsibilities

Guests are expected to:

• Arrive at the departure point at the agreed time
• Follow all safety instructions given by the crew
• Not board or remain on board under the influence of alcohol or substances that impair safety judgment
• Treat the vessel, equipment, and crew with reasonable care
• Inform Breezeway of any medical conditions or mobility limitations relevant to the charter before departure
• Wear life jackets as directed by the crew

Guests who fail to comply with crew safety instructions may be asked to return to port. No refund will be issued in such circumstances.

8. Charter Activities

Snorkeling, paddleboarding, and swimming are permitted during appropriate charter stops. These activities are undertaken at the Guest's own risk. The crew will provide a safety briefing for all water activities. Breezeway is not liable for incidents arising from Guests choosing to participate in water activities against crew advice.

Diving at Koh Tao is facilitated by third-party dive operators. Diving is conducted under the separate terms of those operators, and Breezeway is not liable for diving activities once the Guest is under the supervision of the dive provider.

9. Intellectual Property

All content on this website, including text, images, and design, is owned by or licensed to Breezeway. Guests may not reproduce, redistribute, or use website content without prior written consent.

10. Disclaimers

Charter services are provided in good faith and to a reasonable professional standard. Breezeway does not make specific promises about weather conditions, wildlife encounters, or the precise content of any charter, as these are subject to conditions beyond our control. Itineraries described on this website are representative, not contractually fixed.

11. Limitation of Liability

To the extent permitted by Thai law, Breezeway's total liability to any Guest arising from a charter or related to use of this website is limited to the amount paid for the relevant charter. Breezeway is not liable for indirect, consequential, or incidental losses, including losses arising from missed connecting travel, altered plans, or costs incurred after the charter.

12. Indemnification

Guests agree to indemnify Breezeway against any claims, costs, or liabilities arising from their failure to follow crew safety instructions, their misuse of equipment, or their conduct on board that causes damage or harm to third parties.

13. Termination

Breezeway may terminate a charter early and return Guests to port if safety conditions deteriorate, if crew instructions are not being followed, or in other circumstances that make continuation of the charter inadvisable. In cases of weather-related early return, a proportional adjustment will be offered where reasonable.

14. Governing Law

These Terms are governed by the laws of the Kingdom of Thailand. Any dispute arising under these Terms will be subject to the jurisdiction of the courts of Surat Thani Province, Thailand. Breezeway will always attempt to resolve disputes informally in the first instance.

15. Changes to Terms

These Terms may be updated from time to time. The current version will always be available on this page. Continued use of the website or completion of a booking after an update constitutes acceptance of the revised Terms.
